Wage and Hour Law

Wage and hour litigation is a complex area of law and there are many commonly held misconceptions.  Bringing a claim against a current or former employer for wage law violations can be intimidating. Employers can not fire or discriminate against any employee or group of employees who files a claim for fair compensation.

At Douglas McDaniel & Campo, we fight to make sure that workers receive all of the wages they are entitled to under federal and state law.

Wage and Hour Law

The United States Department of Labor and the Maine Department of Labor have comprehensive sets of laws and regulations and a vast subset of laws that require Maine employers to fairly compensate their employees. Workers are entitled to breaks, sick days and personal time without the threat of punishment or unemployment.

Your attorneys at Douglas McDaniel & Campo know the complicated set of rules and regulations and can help you determine if any wage and hour law infraction has occurred, such as:

Overtime Pay

Subject to certain exemptions, under federal and state law if you work over 40 hours a week you are likely entitled to overtime pay in the amount of 1 1/2 times your regular pay, even if you’re on salary.

If you’ve worked overtime hours without being properly compensated, we can help.

Minimum Hourly Wage

There are minimum hourly wage requirements under federal and state law.  If your weekly compensation does not amount to this minimum hourly wage, you may have a claim for unpaid wages. Even if you are a tipped employee, you are still entitled to be paid a minimum hourly wage.

Unpaid Wages

If you perform job duties while off the clock or otherwise without receiving compensation, you may have a claim for unpaid wages.

Wage and hour violations

We represent groups of workers who have suffered the same kind of wage and hour violations by the same employer in class or collective actions.

Equal Pay

Maine law says that employers must pay employees the same wage for comparable jobs with comparable skill requirements, regardless of gender. If you feel you have been a victim of an equal pay violation, you can make a claim for equal pay.

There are many other ways in which Maine law protects workers in wage and hour law. Please contact our attorneys today for a free consultation.
